Documentation Requirements

 

  1. Obtain FSIS Form 9060-5EP, Egg Products Export Certificate of Wholesomeness.
  2. For all egg products, the following statements must be provided on a FSIS Letterhead Certificate:
    1. "A. The egg products were derived from shell eggs:
      • from birds that were kept in a county free of Highly Pathogenic Avian Influenza (HPAI) and Newcastle Disease, as defined by the OIE; and
      • that are received in containers and packing or packaging materials free from odors and materials which could contaminate or adulterate the eggs or egg products.
                                                                            OR
      B. The product has been pasteurized or heat treated according to USDA regulations, sufficient to
          inactivate the avian influenza viruses and Newcastle disease, as defined by
      the OIE.
                                                                           AND
    2. The means of transport, handling, and loading conditions of the products comply with the hygiene requirements of the United States including the necessary precautions to avoid product contamination with Newcastle disease and avian influenza viruses.
  3. For all egg products, the following Self-Certification statements must be provided on Company Letterhead and signed by the USDA/APHIS accredited veterinarian:
    1. The consignment(s) destined to India do not contain beef and beef products in any form.
    2. The source birds were not fed with feeds containing materials of internal organs, blood meal and tissue of bovine origin.
  4. U.S. Embassy Shipments 
    1. Obtain FSIS Form 9060-5EP, Egg Products Export Certificate of Wholesomeness.
    2. These shipments are not required to meet India requirements and FSIS can issue basic export certification only if the following statement is provided in the “Remarks” section of FSIS Form 9060-5EP: “Product Destined to U.S. Embassy”.

Plants Eligible for Export

All FSIS inspected egg product plants are eligible to export to India.

Certification Requirements

  1. Fresh/Frozen Poultry and Poultry Products
    1. Obtain FSIS Form 9060-5, Meat and Poultry Export Certificate of Wholesomeness.
    2. The following statements must be provided on an FSIS Letterhead Certificate:
      1. The poultry or poultry products were derived from birds which either:
        1. For products not meeting the procedures outlined in the OIE Terrestrial Animal Health Code for the inactivation of the avian influenza viruses in meat:
          1. have been kept in a U.S. county free from infection of highly pathogenic avian influenza and Newcastle Disease, as defined by OIE, in commercial poultry since they were hatched or for at least the past 21 days
            and
          2. have been slaughtered in an U.S. abattoir approved for poultry slaughter in a U.S. county free from infection of highly pathogenic avian influenza and Newcastle Disease, as defined by OIE, in commercial poultry and have been subjected to ante-mortem and post-mortem inspections and have been found free from any signs suggestive of avian influenza.
            OR
        2. In the case of processed poultry products, the procedures outlined in the OIE Terrestrial Animal Health Code for the inactivation of the avian influenza viruses in meat were met.
      2. The poultry products were produced in accordance with the U.S. National Residue Program, which assures that the products do not contain harmful levels of veterinary drugs, pesticides, or environmental contaminants.
      3. The poultry meat was derived from federally certified slaughter and processing facilities that adhere to the U.S. performance standards for Salmonella, which would include, in part, Salmonella typhimurium, Salmonella enteritidis, and Salmonella typhi, among other Salmonella species, which have been verified by FSIS through monitoring of the pathogen reduction and HACCP programs implemented in these facilities.
    3. The following Self-Certification statements must be provided on Company Letterhead and signed by the USDA/APHIS accredited veterinarian:
      1. The consignment(s) destined to India do not contain beef and beef products in any form.
      2. The source birds were not fed with feeds containing materials of internal organs, blood meal and tissue of bovine origin.
  2. Pork and Pork Products 
    1. Obtain FSIS Form 9060-5, Meat and Poultry Export Certificate of Wholesomeness.
    2. The following statements must be provided on an FSIS Letterhead Certificate:
      1. The pork and pork products were derived from federally inspected slaughter or processing facilities, operating under the supervision of FSIS.
      2. The pork and pork products were derived from swine that were slaughtered in the United States or from pork and pork products that were legally imported into the United States.
      3. The pork and pork products were derived from swine that were slaughtered in abattoirs separate from other species’ meat products. The pork and pork products were processed in plant(s) where if species of meat other than pork have been processed, then the pork and pork products have been segregated and controls implemented to ensure that no species other than pork were added at any stage during processing. The pork and pork products do not contain bovine meat.
      4. The pork and pork products were produced in accordance with the U.S. National Residue Program which assures that the products do not contain harmful levels of veterinary drugs, pesticides, or environmental contaminants.
      5. The pork and pork products satisfy the following sanitary requirements:
        1. 1) the United States meets OIE criteria to be free of foot and mouth disease without vaccination, classical swine fever and African swine fever; or
          2) the pork and pork products were treated in a manner consistent with the recommendations of the OIE Terrestrial Animal Health Code to inactivate foot and mouth disease, classical swine fever, or African swine fever; and
        2. The pork and pork products were derived from carcasses that: 
          1. tested negative for trichinosis or
          2. were subject to a freezing process or other mitigation process that guarantees the destruction of the parasite Trichinella spiralis; or
          3. were derived from swine and swine enterprises with certified participation in the National Pork Board’s Pork Quality Assurance Plus (PQAPlus) program, as verified by USDA, which addresses product identification, segregation, wholesomeness, biosecurity, are subject to surveillance conducted in the United States, and have a minimal risk for infection from Trichinella spp.; and
        3. Either:
          1. the United States is free from Aujeskey’s disease in commercial swine; or
          2. the pork and pork products have been heat-treated to inactivate the Aujeskey’s disease virus; or
          3. the fresh pork and pork products do not contain head, thoracic, or abdominal viscera.
      6. The pork and pork products were hygienically handled while under FSIS jurisdiction.
      7. The swine passed ante-mortem veterinary inspection. The swine carcasses and viscera passed FSIS post-mortem veterinary inspection. The pork and pork products were declared fit for human consumption.
      8. Further processed pork products have been subjected to one of the following processes to achieve pathogen destruction: a) cooking or heating; b) curing or drying; or c) fermenting.
      9. The material used in the packing complies with Title 9 Code of Federal Regulations (CFR) Section 317.24 and is enforced by FSIS.
  3. U.S. Embassy Shipments 
    1. Obtain FSIS Form 9060-5, Meat and Poultry Export Certificate of Wholesomeness.
      1. These shipments are not required to meet India requirements and FSIS can issue basic export certification only if the following statement is provided in the “Remarks” section of FSIS Form 9060-5: “Product Destined to U.S. Embassy”.

  2. The use of a single second affixed label to declare certain India-specific label elements is permitted in the principal display area (please see the link for guidance on specific label elements). If two labels are affixed, the name of the product printed on both labels must match exactly (i.e. “poultry meat”, “chicken leg quarters”, etc.) and neither label may be easily separated from the packaging. 
  3. The smallest individual unit of packaging must be labeled for all retail products (i.e. both the outside carton or container and the individually wrapped packages inside). For wholesale products only, the outside carton or container must be labeled, but the individually-wrapped products inside do not need to be labeled.

FSIS advises exporters to work with their importers in India to ensure that the India-specific labeling requirements are met. Examples of compliant labels for poultry and poultry products are attached here for reference.
