Documentation Requirements

All FSIS export certificates accompanying the product must be signed by a FSIS veterinarian. The veterinary degree (DVM or equivalent) must be indicated after the signature.

Plants Eligible for Export

All FSIS inspected egg product plants are eligible to export.

  1. Eligible
    1. All beef and beef products derived from cattle of any age slaughtered on or after March 27, 2015.  An AMS EV Program is no longer required for these products
    2. Effective October 13, 2015, poultry and poultry products from the following States are reinstated as eligible for export:  Arkansas, California, Idaho, Iowa, Kansas, Minnesota, Missouri, Montana, Nebraska, North Dakota, South Dakota, Oregon, and Washington.
    3. Indiana – raw poultry and poultry products from birds slaughtered on or after April 22, 2016 are eligible for export.
    4. Wisconsin - raw poultry and poultry products from birds raised, slaughtered or processed before March 10, 2017 and after September 20, 2017.
    5. Tennessee - raw poultry and poultry products from birds raised, slaughtered or processed before March 10, 2017 and after September 1, 2017.
    6. Poultry Offal
      1. Poultry hearts and livers from birds slaughtered on or after April 1, 2011 excluding any restricted State(s) listed in the Ineligible Section B.
      2. Poultry tongue, feet, tendons, giblets, gizzards, head, necks, paws, skin, wattle, and sex glands from birds slaughtered on or after January 25, 2014 excluding any restricted States listed in the Ineligible Section B.
    7. Pork and pork products.
    8. Pork Offal
      1. Pork heart, liver, and kidney from animals slaughtered on or after April 1, 2011.
      2. Pork intestine, spleen, tongue, feet, lips, cheek meat, ears, jowls, snout, testicles, penis, scrotum, coronary arteries, tendons, brain, eyes, bung, ear base/canal, bladder, head meat, skin, stomach, tail, uteri, whole heads, bones and fat from animals slaughtered on or after January 25, 2014.

    Note: All exporters that wish to export meat and poultry products, other than processed meat and poultry products, to Vietnam must complete Appendix 3 template of "Decree 15". Exporters should work closely with importers and with industry - organizations such as the U. S. Meat Export Federation (USMEF) and the USA Poultry & Egg Export Council (USAPEEC) for assistance in obtaining the Appendix 3 of Decree 15. Appendix 3 must be submitted to U.S. Embassy Hanoi staff at the following e-mail address: usda4circ25@gmail.com or by fax to U.S. Embassy Hanoi staff at: (011 - 84-4) 3850-5130. Following a perfunctory review by the Embassy, the original, hand-signed, Appendix 3, along an original, hand-signed flowchart must be mailed to the U.S. Embassy’s Office of Agricultural Affairs in Hanoi, Vietnam for submission to Vietnam’s Department of Animal Health (DAH).  Note:  Exporters who wish to ship new products to Vietnam must re-submit a revised Appendix 3 indicating the facility’s desire to ship those products to Vietnam.

    Warehouses: It is requested to clarify whether products are registered for quarantine inspection in Vietnam under the cold storages’ approval number or suppliers’ approval numbers.  You may follow either I or II below.   In either scenario below, the exporter must clearly state /identify in the “Remarks” which approval number is being listed on the export certificate.
     
    1. In case where exported products are registered under the cold storage approval number, the warehouse is required to register with DAH due to Decree 15/2018 dated February 2, 2018 of the Government of Vietnam.  Contact the U.S. Embassy Office listed above for assistance.  The warehouse’s approval number must be typed in the Remarks of FSIS Form 9060-5.
    2. In cases where exported products are sourced from an establishment / supplier on DAH’s list, the supplier’s approval number must be typed in the “Remarks” of FSIS Form 9060-5.

The date of manufacture/production date/packing date and the expiration date or best-use-by date is preferred in the order of day, month, and year. The day shall consist of two numerals, month consists of two numerals, and year consists of two or four numerals. Dot symbol (.), dash (-), cross (/) or no symbol, can be used between day, month, year. The numbers indicating a single day, month and year sequence must be presented on the same line.

“Manufacture date” and “Expiration date” may be recorded with their abbreviation in upper-case letters as “MFG” and “EXP”, respectively. “Manufacture date” may also be referred to as “Production date” or “Packing date”. “Best-use-by” date may also be recorded with the words “Best before…”.

For example: if date of manufacture /production /packing is April 2, 2010 and expiry date/best-use-by date is October 2, 2011, they can be presented in accordance with the following formats:

NOTE: Establishments exporting fresh and frozen meat and poultry products to Vietnam must display on the label the facility number, consistent with how the establishment number is listed on the DAH website.   While the facility name is not required to be on the label or health certificate, it is preferred by Vietnam.  When the facility name is included on the label, exporters should take care to ensure that any corresponding references to the establishment name on the applicable Health Certificate and the label content in terms of the producing facility’s name, match as it appears on the DAH website.

Beginning on December 21, 2020, all FSIS export certificates accompanying the product must be electronically signed by a FSIS veterinarian. PHIS will add the veterinary degree (DVM) to the printed name of the approving FSIS veterinarian in the signature box of the export certificate. 

NOTE: Effective for all export certificates approved, signed, and issued on or after December 21, 2020, the export applicant will select the appropriate statements below via the PHIS statements module when completing the export application in PHIS. The selected statements will be added by PHIS to FSIS Form 9060-5B.

  1. For poultry and poultry products, including offal - obtain FSIS Form 9060-5, Meat and Poultry Export Certificate of Wholesomeness and select the following statement in PHIS via the statements module:
    1. The birds from which the product was derived originated from a zone free of highly pathogenic notifiable avian influenza.
       
  2. For beef and beef products from cattle of any age slaughtered on or after March 27, 2015.  Obtain FSIS Form 9060-5, Meat and Poultry Export Certificate of Wholesomeness and select the following statements in PHIS via the statements module:
    1. The beef and beef products were derived from federally certified slaughter and processing facilities, operating under supervision of the Food Safety and Inspection Service (FSIS).
    2. The cattle from which the beef and beef products were derived were not subjected to a stunning process, prior to slaughter, with a device injecting compressed air or gas into the cranial cavity or to a pithing process.
    3. The beef and beef products were derived from cattle that received ante- and post-mortem inspection determined to be fit for human consumption by FSIS inspection personnel, and were not from suspect or confirmed BSE cases.
    4. The beef and beef products were not derived from the following specified risk materials: the brain, skull, eyes, trigeminal ganglia, spinal cord, vertebral column (excluding the vertebrae of the tail, the transverse processes of the thoracic and lumbar vertebrae, and the wings of the sacrum), and dorsal root ganglia of cattle 30 months of age and older; and the tonsils and distal ileum of the small intestine of any cattle regardless of age.
    5. The beef and beef products do not contain any advanced recovery meat derived from the skulls and vertebral columns of cattle 30 months of age and older nor mechanically separated beef from any cattle regardless of age.
    6. The United States prohibits the feeding of ruminants with ruminant-origin meat-and-bone meal and greaves, and this regulation is effectively enforced.
       
  3. Protein-free beef tallow. Select the following certification statement in PHIS  via the statements module:
    1. The protein-free tallow covered by this certificate has been tested for content of insoluble impurities with the results below 0.15% in weight.

      This certification statement will be included on the export certificate based on the presentation of a certificate issued by an independent laboratory report (not belonging to the exporter and/or the manufacturer).
       
  4. Pork and pork products - obtain FSIS Form 9060-5, Meat and Poultry Export Certificate of Wholesomeness.
  5. Pork Offal - obtain FSIS Form 9060-5 Meat and Poultry Export Certificate of Wholesomeness and select the following statement via the statements module:
    1. The meat or meat food product specified hereon is from animals that received both antemortem and postmortem inspection and were found sound and healthy and that it has been inspected and passed as provided by law and regulations of the Department and is sound and wholesome.

All federally inspected establishments are eligible to apply for export to Vietnam. However, facilities must register a Decree 15 Appendix 3 with Department of Animal Health (DAH) and be listed on the DAH approved export establishment list before shipping product to Vietnam. Additional Import Information

The products identified in the table above are eligible for export from Vietnam to the United States as determined by the United States Department of Agriculture (USDA), Food Safety and Inspection Service (FSIS) Equivalence Process.

Vietnam has been allowed to export Siluriformes fish and fish products to the United States under the conditions described in the proposed rule (83 FR 47528). On November 5, 2019, FSIS published a final rule to list Vietnam in the regulations as eligible to export Siluriformes fish and fish products to the United States.

Source materials used to produce product intended for export to the United States must originate from a certified establishment in an eligible country that has an equivalent raw or processed products inspection system.

The above are the Process Categories, Product Categories, and Product Groups as listed in the FSIS Product Categorization document and defined in the Public Health Information System (PHIS).

  • For raw Siluriformes products, the Order Siluriformes includes the following Families: Ictaluridae (Catfish), Clariidae, Pangasius, and others.  For guidance on acceptable common or usual names, see Siluriformes Fish Species List.

A certified establishment is an establishment that the Central Competent Authority (CCA) of the foreign country has certified as meeting the requirements of the inspection system that FSIS has determined equivalent to the United States inspection system and, therefore, eligible to export meat, poultry, or egg products to the United States.
