WASHINGTON, March 27, 2002--Phuong Van Nguyen, doing business as Souderton Oriental Food Market, in Souderton, Pa., entered into a consent agreement in federal court on Oct. 18, 2001, as a result of several violations of the Federal Meat Inspection Act and the Poultry Products Inspection Act, the U.S. Department of Agriculture's Food Safety and Inspection Service announced today.
The defendant acknowledged purchasing unlabeled and uninspected meat products from unknown suppliers on many occasions, and then selling the products to his retail customers.
Under terms of the agreement, Phuong Van Nguyen is prohibited from selling, transporting, receiving or offering for sale, any uninspected or misbranded meat or poultry products. He must also maintain accurate records at his market for each product he buys or sells that show the source of the meat, meat product, poultry or poultry product. These records must be made fully accessible to authorized FSIS officials.
If any of the conditions of the agreement are violated, the defendant would pay for the first violation a fine of $100 per pound for violative product, and $500 per pound for any other violation. Van Nguyen would also be required to pay court costs, attorney fees and all expenses incurred by FSIS officials.
This legal action is a result of an investigation conducted by FSIS officials. FSIS is responsible for ensuring that meat, poultry and egg products are safe, wholesome and correctly labeled.
